While we strive for accuracy and we share knowledge based on our experience in jewelry-making and materials, we make no guarantees that the information is complete, reliable, or up-to-date.

  • If we provide a guide on “How to Care for Your Jewelry,” these are best practices but we cannot promise that following them will yield a particular result (there are many factors like individual skin chemistry, water quality, etc.). Use your best judgment when applying any advice.

  • If we describe metaphysical or historical properties of gemstones (e.g., “Rose quartz is said to promote love and harmony”), this is drawn from folklore or customer interest, and should not be taken as fact or medical advice. We are not scientists or medical professionals; such statements have not been evaluated by any official body. They are provided as interesting information only.

  • Any business or legal-related content (if we ever blog about “running a craft business” or similar) is from personal experience and not from a licensed professional.

We expressly disclaim any liability that may arise from your use of or reliance on information on our site that may be misinterpreted as professional advice.

3. Affiliate & Advertising Disclosure

Transparency about affiliate links and potential earnings is important to us:

  • Affiliate Links: As noted, we participate in affiliate programs. This means if we mention or recommend a product that we don’t sell (for instance, a particular jewelry supply, a display case, or something we use in our craft or office), we might provide a link that is tracked. If you click that link and buy the product, we may earn a small commission (often a few percent of the sale) from the merchant. It does not cost you anything extra. It’s a way for us to monetize recommendations of products we genuinely use or like. We only become affiliates for products or companies we trust.

  • We hereby disclose that Tammi Zentic is an Amazon Services LLC Associates Program participant (if applicable) or any other affiliate networks we join. For example, if we provide a link to, say, a jewelry cleaning solution on Amazon, assume it’s an affiliate link.

  • We will mark pages or posts clearly if they contain affiliate links. You might see phrasing like “This post may contain affiliate links. As an Amazon Associate, I earn from qualifying purchases.” We include that in line with FTC requirements for affiliate disclosures.

  • Even though we earn commissions, we always prioritize honest opinions. We won’t recommend something just for commission – if we wouldn’t buy it ourselves, we won’t tell you to. Commission earnings just help support our small business (covering website costs, etc.).

  • Advertising: Currently, our website does not display third-party banner ads or Google AdSense, etc. If that changes, we will update this section and ensure ads are distinguishable as advertisements. If ads are present, note that we do not necessarily endorse the products/services in those ads. They are served by ad networks, and we might not have control over which specific ads appear.

4. Testimonial Disclaimer

We love to share testimonials and feedback from our happy customers (for example, reviews on our site or quotes from emails). When we present testimonials:

·       They are the real, verbatim words of our customers (we may edit for spelling or length, but we do not fabricate testimonials).

·       Any images shared (like a customer photo wearing our jewelry) are used with permission. Sometimes customers tag us on social media and we may repost that – if you prefer we not, let us know and we will take it down.

·       Individual results/experiences may vary: A testimonial is by nature a reflection of one person’s experience.

 

While we hope all customers are as satisfied, there’s no guarantee that everyone will have the exact same positive outcome.

 

For instance, a review might say “this bracelet never tarnishes!” – it’s true for that person under their conditions, but if someone else wears it 24/7 in saltwater, their experience might differ.

 

Or someone might rave that wearing a certain crystal made them feel happier – that’s a personal, subjective experience and not a promise that you’ll feel the same.

·       We are not paying for positive reviews. If any customer received a discount or incentive in exchange for providing a review or testimonial, we will disclose that clearly (in line with FTC endorsement guidelines).

 

Generally, our testimonials are voluntary. If we do a promotion like “leave a review and get a coupon,” we’ll still publish honest reviews (even if constructive criticism) and disclose the incentive.

5. Third-Party & External Content

Our site may include content or integrations from third parties.

 

For example, an Instagram feed plugin showing latest posts, or a YouTube video tutorial embedded, or a blog comment feature powered by Disqus.

 

We want to clarify:

·       We do not have full control over third-party content. If an embedded Instagram feed shows a comment or image that is offensive (perhaps a spam comment), we will remove or moderate it when noticed, but it’s pulled dynamically from Instagram’s servers.

 

We disclaim liability for third-party content that we did not create.

·       If our blog allows guest posts or comments by users, those reflect the views of the authors, not necessarily our view.

 

We are not responsible for and do not always verify every fact in a guest content. That said, we will never knowingly allow false or harmful info – if we find out something is incorrect or problematic, we will correct or remove it.

6. Permanent Jewelry Service – Waiver of Liability (Summary)

Customers who partake in our permanent jewelry welding service are required to sign a detailed waiver form before the service (see Terms and Conditons Section 2.3 and the actual waiver for full details).

 

In summary here, we want to disclaim:

·       Assumption of Risk: By getting a permanent bracelet/anklet, you understand the process involves a small welding arc. While we use safety precautions (protective glasses, shielding of skin, etc.), you assume the risk of minor burns or injury. We have not had incidents beyond an occasional tiny “spark” feeling, but the risk exists and you acknowledge it.

·       Release: You release Z.Harvest Gems and Tammi Zentic from liability for any injuries, allergic reactions, or complications arising from the service or the jewelry afterward, to the extent permitted by law. We are not liable if, for example, you later catch the bracelet on something and injure yourself – please exercise care.

·       No Medical Liability: If you have a medical device or condition that could interact with metal or the welding (e.g., pacemaker concerns, or epilepsy triggered by bright light, etc.), it is your responsibility to consult a doctor before doing this. We are not medical experts and cannot advise on that. By proceeding, you are confirming you’re not aware of any medical reason to avoid it.

·       Minors: As stated, minors need parental consent. Parents who consent for their minor are accepting the above risks on the minor’s behalf. If you’re a parent signing, you also agree to indemnify us for any claims by or on behalf of the minor later. In plain terms, you won’t later sue us claiming we shouldn’t have allowed it, because you gave permission.

 

We do everything with caution and care, but this covers us legally.

7. Accuracy of Materials

We strive to display and describe our products as accurately as possible on the website. However, due to differences in display screens or lighting, the colors of products (gemstones, beads) on the screen might not perfectly match real life. Also, being handmade, each piece can have slight unique aspects.

 

We disclaim that there may be minor discrepancies (for example, a stone’s pattern might vary). These are not considered defects. If an exact hue or size is critical, contact us for verification before purchase. We are happy to provide more photos or details to ensure you know what you’re getting.

We also reserve the right to correct any errors in the site content (including pricing errors, typos, etc.) whenever discovered. If such correction affects an order (like a price error after you ordered), we will contact you to resolve it (see Terms and conditions about order errors).

8. Endorsement Disclaimer

Mention of third-party brands, products, or services on our site (outside of affiliate context) does not constitute an endorsement or recommendation unless explicitly stated.

 

For example, if we mention “We use XYZ brand tools in our studio,” that’s just a factual statement, not a formal endorsement or partnership.

 

Conversely, if we do endorse something (like “we highly recommend ABC for insurance”), it’s still just our opinion and not a guarantee from us of that third party’s performance. Do your own due diligence as needed.

9. No Guarantees of Results

Whether it’s the effectiveness of a cleaning method, the metaphysical effect of a crystal, or the durability of a material – we cannot guarantee specific outcomes.

 

We provide quality products and advice to the best of our ability, but many factors outside our control influence results (how jewelry is worn/cared for, individual differences, etc.).

 

Thus:

  • We do not guarantee that wearing our jewelry will result in compliments (though we hope it does!), or that giving it as a gift will result in a certain reaction, etc. Those are subjective experiences.

  • We don’t guarantee any increase in well-being from any gemstone attributes.

  • We can guarantee you will receive a product that matches the description and is free from manufacturing defects on delivery – and if not, we guarantee we’ll fix it as per our policies. But beyond the tangible aspects, any ancillary benefits or outcomes are not guaranteed.
