Welcome to Z.Harvest Gems!
These Terms and Conditions (“Terms”) govern your use of the Z.Harvest Gems website (https://www.zharvestgems.com) and any purchase or service you obtain from us, whether online through our site or in person (for example, at events or pop-ups).
By accessing our site or purchasing our products/services, you agree to be bound by these Terms, as well as our Privacy Policy and other policies referenced herein. If you do not agree, please refrain from using our website or services.
Throughout these Terms, “Z.Harvest Gems” or the “Company” refers to Tammi Zentic d/b/a Z.Harvest Gems.
“You” or “Customer” refers to any person accessing the site or making a purchase from us.
1. Use of the Website
1.1 Eligibility: You must be at least 18 years old to purchase products or services from our site. If you are under 18, you may use the site only with involvement and consent of a parent or guardian.
By using the site, you represent that you are of legal age or have appropriate consent. (Note: Certain payment options like Affirm or Afterpay also require you to be 18+ to use them.)
1.2 Account Creation: Our site may allow you to create an account for easier checkout or order tracking. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for any activities under your account.
Please use a strong password and notify us immediately at the contact info below if you suspect unauthorized access to your account.
You agree to provide accurate, current information about yourself and to update it if it changes. We reserve the right to suspend or terminate accounts that are suspected of fraud or misuse.
1.3 Acceptable Use: You agree to use our website only for lawful purposes.
You shall not use the site in any way that:
(a) violates any applicable federal, state, or local law or regulation;
(b) is fraudulent, false, or misleading;
(c) infringes on our or any third party’s intellectual property or other rights; or
(d) could damage, disable, or impair the site (such as introducing viruses or hacking attempts).
We reserve the right to restrict or terminate your access to the site if you engage in prohibited behavior. No scraping, data mining, or unauthorized use of our content is allowed. You also agree not to use the site to send unauthorized advertising or spam.
1.4 User Content and Comments: If our site allows reviews, comments, or customer content submissions, you are solely responsible for what you post.
Content that is offensive, defamatory, harassing, obscene, violates any law, or infringes others’ rights is strictly prohibited. We may moderate, edit, or remove user submissions at our discretion.
By posting content (like a review or testimonial) on our site or tagging us on social media with your content, you grant Z.Harvest Gems a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display that content in connection with our business (for example, we may showcase your testimonial on our site or share your tagged photo on our Instagram, with credit to you).
This license lasts until you revoke it by contacting us or deleting the content.
Any opinions or content posted by users are their own and do not represent our opinions; we disclaim liability for user-posted content but will act promptly to remove content that is unlawful or infringing once we’re notified.
2. Products and Services
2.1 Handmade Jewelry Products: We sell handmade jewelry items, including but not limited to necklaces, bracelets, earrings, and rings, often crafted with natural gemstones, crystals, metals (such as sterling silver, gold-filled, etc.), and other quality materials. Please note that because products are handcrafted, each piece may have slight variations in color, size, or appearance.
We do our best to photograph and describe items accurately, but minor differences or imperfections (which are normal in handmade goods) are not considered defects. If you have questions about an item (size, materials, allergies, etc.), feel free to contact us before purchase.
We want you to love your piece, and we stand by the craftsmanship of our work.
2.2 Product Availability: All orders are subject to product availability. We update our inventory regularly, but if an item is unexpectedly out of stock or delayed, we will inform you promptly.
We reserve the right to limit quantities of products we supply or to discontinue any product at any time. Prices for our products are subject to change, but any such change will not affect orders that have already been placed and confirmed.
2.3 Permanent Jewelry Service: We offer permanent jewelry application, a service where a bracelet/anklet/necklace is custom-fitted and welded directly on the customer so it has no clasp (often called an “endless” bracelet).
Important Service Terms:
- Appointments: Permanent jewelry is typically done by appointment at events or pop-ups. Booking may require a deposit or prepayment (if specified at booking). We will communicate any booking fee and policy (e.g. refundable or not for no-shows) at the time of scheduling.
- Waiver & Consent: This service involves a quick welding process to solder the chain. While it is generally safe and the equipment is designed for jewelry, it does involve a tiny hot flame or electrical weld.
All customers must sign a Waiver and Release of Liability form before receiving permanent jewelry. The waiver will explain the procedure and its risks, and by signing you acknowledge and accept those risks and release Z.Harvest Gems/Tammi Zentic from liability for any minor injuries or reactions, except in cases of gross negligence. If you are unwilling to sign the consent/waiver, we cannot provide the service.
- Risks: You acknowledge that permanent jewelry welding involves a small spark of heat and there is a minor risk of burns, skin irritation, or injury (the risk is low, as we take precautions, but it is not zero).
You also acknowledge that the jewelry, once welded, is designed to be long-lasting/permanent until you choose to remove it by cutting. We use quality materials (14k gold-filled, sterling silver, etc.), but if you have metal allergies or sensitive skin, you must inform us beforehand.
We are not responsible for allergic reactions, since we do disclose the metals used (if you know you are allergic to, say, nickel or certain metals, please choose an appropriate metal or refrain from the service).
- Minors: Customers under 18 years of age must be accompanied by a parent or legal guardian for permanent jewelry services. The parent/guardian must sign the waiver on the minor’s behalf, consenting to the procedure.
We reserve the right to refuse service to minors under a certain age even with consent (for example, very young children) if we believe they cannot safely participate or sit still for the procedure. This is for everyone’s safety. If you have questions about an appropriate age, please contact us.
Generally, older teenagers can get a permanent bracelet with parent present; under roughly 14 we may suggest waiting until they’re older.
- Aftercare: We will provide care instructions. Permanent jewelry can be worn continuously, but customers should still exercise common sense. The pieces are delicate chains – excessive force can break them.
Avoid exposing the jewelry to extreme chemicals or pulling. If at any point you want to remove the jewelry, you can cut the chain off with scissors or pliers at home (carefully). You can keep the chain and we may be able to re-weld it later (small fee may apply for re-welding).
Note: We do not cover the cost of someone else removing it (e.g. if you go to a jeweler to have it cut off).
- No Refunds on Service: Once a permanent jewelry piece is welded on, it is considered a final sale.
We cannot undo the service (except by cutting the chain, which ruins it), so there are no refunds or exchanges for permanent jewelry services after the fact. If your chain breaks at the welded spot shortly after the service, contact us – we may fix or re-weld it at no charge, as that can indicate an issue with the weld.
However, breaks due to snagging or stretching the chain, or general wear-and-tear, are not covered for free repairs (we can repair for a small fee). We strive for quality work so that doesn’t happen often.
- Right to Refuse: We reserve the right to decline providing the permanent jewelry service to anyone for safety or appropriateness reasons. (Examples: if a customer has a skin condition or wound in the area, if a child is too young, or if someone appears to be under the influence of substances that could make the process unsafe, etc.) This is to ensure a safe and positive experience for everyone.
2.4 Digital Products: Starting in 2026, Z.Harvest Gems may offer digital products (for example, downloadable artwork, jewelry-making tutorials, printable gift certificates, etc.).
When you purchase a digital item:
- You will receive a personal use license for that product. This means you can use the file or content for your own personal, non-commercial purposes (such as printing it for yourself or using the tutorial to craft for yourself).
- Restrictions: You may not resell, redistribute, or share the digital product files with others, and you may not use them for commercial purposes unless explicit written permission is given.
For instance, if we sell a PDF guide or an art print file, you cannot email it to your friends or upload it elsewhere; each person should purchase their own copy. You also cannot claim the content as your own creation. All digital materials are protected by copyright and remain our intellectual property.
- You may make backup copies for personal archival use, and of course you can enjoy the product indefinitely, but the license is only for one user/customer.
- Because digital products are immediately accessible and irrevocable (you can’t “return” a digital file in the same way a physical product can be returned), all sales of digital products are final.
If you have an issue accessing the file or it’s corrupted, we will certainly assist or provide a working copy, but we generally do not offer refunds on digital downloads. If you accidentally purchase multiple times or something, contact us and we’ll work out a solution.
2.5 Print-on-Demand Merchandise: We may offer products that are made to order by a third-party printing service (for example, apparel, tote bags, or mugs featuring Z.Harvest Gems designs or slogans). These items will be labeled on the site as such.
Special terms for these:
- Fulfillment Time: Print-on-demand (POD) items are produced after you order, so they may have longer processing times (usually an extra 2-7 days) before shipping. We will give an estimate in the product description.
- Shipping: POD products might ship separately from handmade jewelry items, especially if they are made by a partner facility. You won’t incur extra shipping charges for separate shipments if it was one order, but they may arrive at different times.
- Quality and Variations: The printing process may result in minor variations in color or positioning of the design compared to the mockup image. These slight differences are normal.
We work with quality providers, but if a print is significantly off or the product is defective, please contact us with a photo and we will address it (likely by reprinting and reshipping at no cost to you).
- Returns: Because POD items are custom-made for your order, we treat them as final sale unless there is a defect or printing error.
If you ordered the wrong size apparel or you simply changed your mind, we cannot offer a free exchange/return on POD products (since there’s no inventory to put it back into; it was made just for you).
However, if there’s a problem with the product quality (like you received the wrong item, or there’s a glaring misprint or damage), we will of course make it right by replacement or refund.
Always reach out within 7 days of receiving a POD product if there’s an issue, and include a photo of the problem.
3. Ordering and Payment
3.1 Order Process: To place an order on our website, add your chosen items to the online cart and proceed to checkout. You will be asked to provide necessary details (name, shipping address, etc.) and payment information.
Please review your order (items, quantities, and shipping info) before finalizing, as we are not responsible for delivery failures due to incorrect addresses or similar user error. If you spot a mistake after ordering, contact us immediately and we will try to correct it if the order hasn’t shipped.
Your submission of an order is an offer to buy the products; the order is only accepted (and a contract formed) when we process payment and send a confirmation.
We reserve the right to reject or cancel any order for any reason, such as suspected fraud, errors in pricing, or stock issues. If an order is canceled after payment, we will issue a full refund.
3.2 Pricing and Currency: All prices on the site are in U.S. Dollars. They exclude shipping (unless otherwise noted) and any applicable taxes.
At checkout, you will see the added shipping cost (if any) and sales tax if applicable to your state. Nebraska residents will be charged sales tax according to law, and we may collect sales tax for other states if our sales volume there requires it (we follow state nexus laws). International buyers (if we open up international shipping) would be responsible for any customs duties or import taxes on delivery.
We strive to ensure accurate pricing, but if there’s a typo or obvious error in price, we reserve the right to correct it and either cancel or contact you to reconfirm the order at the correct price.
3.3 Payment Methods: We offer several payment options for your convenience:

Credit/Debit Cards: Major credit cards (Visa, MasterCard, American Express, Discover) are accepted and processed securely via Stripe. When paying by card, you agree to abide by your card issuer’s terms. We do not surcharge for credit card payments (no extra fees beyond the order total).

PayPal: You can choose PayPal at checkout to pay via your PayPal balance or linked accounts. If you select PayPal, you will be redirected to PayPal’s site to complete payment securely.

Digital Wallets: Options like Google Pay or Apple Pay may be available for a faster checkout if you have those set up on your device. These also are processed via our payment gateway.

Buy Now, Pay Later (BNPL): We may offer financing/installment options at checkout such as Afterpay, Affirm, or Klarna. If you choose one of these, you will typically pay a portion of the total at checkout and agree to pay the remainder in installments per that provider’s terms. Important: Using these services is subject to approval by the third-party provider and you must meet their eligibility criteria (usually, 18+ years old, valid U.S. residency, etc. – for example, Affirm requires users to be at least 18 years old (19 in some states) and to pass a soft credit check). The BNPL provider’s terms (including any interest or late fees) will be presented to you during the process; please read them carefully. By using a BNPL option, you understand that your agreement to pay is with that provider, not directly with Z.Harvest Gems – the provider pays us upfront for your purchase, and you then owe the provider under whatever installment plan you agreed to. We are not responsible for any decisions by these third parties to decline financing, nor for any additional fees or interest they may charge you. We simply offer it as a convenience to customers. If you have issues with a BNPL payment schedule, you must contact the provider (Afterpay, Affirm, or Klarna) as we cannot alter your payment plan.

Other Methods: If we are selling in person (craft fairs, etc.), we may accept cash, credit cards via a card reader, or other local payment apps. For online transactions, stick to the provided methods on our site. Please do not send cash or checks via mail for online orders unless we have expressly agreed on a special arrangement.
3.4 Payment Security: All online payments are processed through secure, PCI-compliant platforms. Z.Harvest Gems does not receive or store your full credit card number or banking credentials when you pay online; that information is handled by Stripe, PayPal, or the respective gateway.
We will see confirmation of your payment and necessary info to ship your order (address, etc.), but your sensitive payment data is not visible to us.
We make every effort to ensure our site is secure – our checkout is SSL encrypted to protect data in transit. However, you are responsible for using a secure connection and protecting your own account passwords.
If you suspect any fraud or unauthorized use of your payment method, please contact us and your payment provider immediately.
3.5 Order Confirmation: After you place an order, you should receive an email confirmation summarizing the order. This confirms we received it.
Once we charge your payment method successfully and begin processing, you’ll get another notification (or the initial one will reflect payment). If any item is unavailable or any issue arises, we will reach out to you via email or phone.
Please ensure you enter a valid email address that you check, so you receive these communications. If you don’t get an order confirmation within a few hours of placing the order, check your spam folder or contact us to confirm if the order went through.
3.6 Cancellation Policy: If you need to cancel or change an order, contact us as soon as possible (within 12-24 hours ideally). We will do our best to accommodate, as long as the order hasn’t been shipped or the custom work hasn’t begun.
Once an item is shipped, or once a custom/personalized order is in production, we may not be able to cancel it.
For permanent jewelry appointments, if you need to cancel or reschedule, please do so according to the instructions given at booking (typically we’d ask for 24-48 hours notice to reschedule).
We reserve the right to cancel an order for any reason (with full refund), such as suspected fraud or pricing error, as mentioned before.
4. Shipping & Delivery
4.1 Shipping Locations: At this time, we ship orders to addresses within the United States. (If we decide to offer international shipping, we will update this section with applicable terms.) We do not ship to PO boxes for certain carriers if not allowed (if that’s an issue, we’ll let you know). We ship from Nebraska, USA.
4.2 Shipping Carriers and Rates: We typically use [USPS First Class or Priority Mail] for most jewelry orders. During checkout, you will see the shipping options available, which may include standard and expedited methods with associated costs.
Free shipping promotions, if offered (like free standard shipping for orders over a certain amount), will be explained on the site. We aim to keep shipping costs reasonable and often charge below actual cost as a courtesy.
Any estimated delivery times provided (e.g. 2-5 business days for standard shipping) are estimates only, not guarantees. Actual delivery could vary due to carrier delays, weather, etc.
4.3 Processing Time: Please allow us some time to process your order. Our normal processing time is about [1-3 business days] for ready-made items. Many of our pieces are made-to-order; if so, it might take [3-5 business days] to create before shipping. We will note on the product page if an item has a longer lead time (like a handmade item that takes a week to craft, or a pre-order).
During busy periods (holidays, large influx of orders) or if we are traveling for events, processing might extend slightly; we will communicate any unusual delays on our site or via email.
Permanent jewelry appointments involve no shipping (the service is done in person), but if you purchase a gift card or a kit online, similar processing applies.
4.4 Delivery and Risk: Once we hand your package over to the shipping carrier, you’ll receive a shipment notification with a tracking number (via email). It’s then in the hands of the carrier. Risk of loss or damage to products passes to you when the carrier delivers the package to your designated address.
Please ensure the shipping address is safe and accurate. If tracking shows delivered but you can’t find the package, check with household members/neighbors and contact the carrier. We can assist with filing a trace or claim, but note that our responsibility is to ship to the address provided.
We are not automatically liable for theft or loss after delivery (consider having items delivered to a secure location if package theft is a concern in your area). We insure packages over a certain value, so if something goes truly missing in transit (tracking never shows delivery), we will work with you to make it right (either through re-shipment or insurance claim).
4.5 International Shipments (if offered): [Currently we do not ship internationally. If this changes, we will include details about customs, duties, and longer transit times here.]
4.6 Events / Local Pickup: If we arrange local pickup or if you buy an item in person at an event, delivery is essentially hand-to-hand at that time.
Once you have the item, the sale is completed and it’s in your care. For local pickups arranged via the site (e.g. you select “pick up” instead of shipping, if we offer that), we will coordinate a time/place in Fremont, NE.
If you fail to pick up within a certain timeframe without communication, we may ship the item to you instead (and charge shipping) or cancel the order per our discretion. But we’ll always attempt contact first.
5. Returns, Exchanges, and Refunds
We want you to be happy with your jewelry. If there’s an issue with your order, please contact us at [contact us page] so we can assist.
Our general policies:
5.1 Eligibility for Return: Most ready-to-wear jewelry items (standard necklaces, rings, bracelets that are not custom-made) are eligible for return or exchange within 14 days of delivery.
To be eligible, the item must be in its original condition, unworn (other than trying it on), and in the original packaging.
For hygiene reasons, earrings (if they’ve been worn) might not be returnable – if you tried them on and decided against them, please email us to discuss. Any item that shows signs of wear or damage by the customer may be refused for return.
5.2 Non-Returnable Items:
- Permanent Jewelry Services: As noted, permanent jewelry applications are final sale and not reversible – no refunds once the chain is welded on. If you paid a deposit for an appointment and didn’t show up or canceled late, the deposit may be non-refundable as per the booking terms (we will communicate that at booking).
- Custom Orders: If you ordered a custom-designed piece or a personalized item (e.g. a necklace with a specific name or a one-of-a-kind commission), that sale is final. Custom pieces are made specially for you and can’t be resold easily. However, if there’s a defect or it’s not made as agreed, we will of course correct that.
- Digital Products: All digital download sales are final (no returns or refunds), as explained earlier, since digital content cannot be “returned” once delivered. If you have trouble accessing a file or it was not as described, we can work on a case-by-case resolution (perhaps a replacement file or an alternative format), but change-of-mind refunds aren’t possible for digital goods.
- Print-on-Demand Products: As noted, POD items are final sale unless there is a defect or printing error. We cannot accept returns for sizing issues or buyer’s remorse on these custom-printed items. Please review size charts and product details carefully before ordering POD apparel. If defective, see 5.5 below.
- Sale/Clearance Items: If an item was marked as “Final Sale” or clearance, then it is not returnable.
We will indicate on the product page if this is the case.
5.3 Return Process: To initiate a return, please email us at [zharvest.gems@gmail.com] within 14 days of receiving your order. Include your order number, the item you wish to return, and the reason (feedback helps us improve, but you’re not obligated to provide one). We will reply with return instructions.
Typically:
- You will be responsible for return shipping costs (unless the return is due to our error or a defect). Use a trackable shipping method and consider purchasing insurance for high-value items, because we can’t issue a refund for an item we don’t receive back.
- Pack the item securely in its original box (or a similarly protective package) to avoid damage in transit.
- Once we receive and inspect the returned item, we will process your refund to the original payment method within a certain number of days (usually 5 business days). We will notify you of the refund. Original shipping fees are usually not refundable (again, unless we messed up the order).
- If you prefer an exchange (for a different size or a different item), let us know – we can often accommodate if the alternate item is in stock.
We’ll treat it as a return of the original and a new purchase of the new item, but we can coordinate so you’re not double charged (e.g. we’ll send an invoice or set up an exchange order).
Any price difference will be handled (if new item is more, we’ll invoice the difference; if less, we can refund the difference).
Additional shipping might apply for sending out an exchange item, but we’ll discuss that case by case.
5.4 Condition of Returned Items: Please note that if a returned item is not in its original condition (e.g. it’s clearly been worn, damaged, or altered), we reserve the right to deny the refund or issue a partial refund.
We’re reasonable and understand minor things (like a single try-on or slight tarnish from being handled) can happen, but obvious wear or misuse (perfume smells, scratches, bent components) will affect your eligibility.
We will document any such issues with photos and communicate with you. In cases of extreme damage or misuse, we may return the item back to you instead of refunding.
5.5 Defects or Order Errors: If we made an error (sent the wrong item, wrong size, or there’s a workmanship defect), please inform us as soon as you receive the order. In such cases, we will make it right – usually by sending a replacement at our cost or providing a full refund, and we will cover any return shipping needed.
Our jewelry is handmade, so we inspect each piece, but if something slipped by (e.g. a loose stone or a broken clasp on arrival), that’s on us.
Similarly, if a print-on-demand item arrives misprinted or damaged, send a photo and we will have our partner reprint and send a new one free of charge, or refund you if reprint isn’t viable. Your satisfaction is important, and we will prioritize correcting mistakes.
5.6 Gift Returns: If you received an item as a gift and you’d like to return or exchange it, please contact us. If the item was marked as a gift at purchase, we can offer you store credit or exchange without alerting the gift giver.
If it wasn’t marked as a gift, the refund will go to the original purchaser (which might notify them). We can discuss options to ensure you’re taken care of discreetly.
6. Intellectual Property Rights
6.1 Our Content: All content on the Z.Harvest Gems website – including product photos, product descriptions, designs, logos, graphics, text, and the overall website design – is the property of Z.Harvest Gems (Tammi Zentic) or its content suppliers and is protected by intellectual property laws (copyright, trademark, etc.).
This includes the jewelry designs themselves and any digital patterns or products we create.
You may not use our copyrighted works or trademarks without our prior written consent, except as allowed by law (such as fair use for commentary).
Purchasing a product gives you ownership of that physical item, but not any intellectual property rights to reproduce the design commercially. (In other words, please don’t copy our designs for resale, and do not use our product images for your own selling or marketing without permission.)
6.2 Limited License for Site Use: We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes – i.e., shopping or learning about our products.
You may not download or copy content (other than for page caching) without our permission, except where we provide downloads (like digital products you purchased or free resources).
Any unauthorized use terminates the permission to use our site.
6.3 Trademarks: “Z.Harvest Gems” and our logos or slogans are trademarks/service marks owned by Tammi Zentic. You may not use any metatags or hidden text containing our trademark without our express consent.
All other trademarks that appear on our site (e.g. Wix, PayPal, Instagram, etc.) are property of their respective owners and are used to refer to those companies or services.
6.4 Third-Party IP: We respect intellectual property rights of others. If you believe that content on our site infringes your copyright or other IP rights, please notify us at [contact us page] with specifics (URL of content, proof of ownership, your contact info).
We will promptly investigate and remove or disable the disputed content if it is indeed infringing. We comply with the Digital Millennium Copyright Act (DMCA) process for takedown notices. Similarly, if we showcase user-generated content (like a customer photo) and you believe it’s used without permission or you want it removed, contact us and we will address it.
7. Affiliate Links and External Links
7.1 Affiliate Disclosure: Tammi Zentic and Z.Harvest Gems may participate in affiliate marketing programs. This means some links on our site or blog might lead to external retailers or products where, if you make a purchase, we could earn a small commission.
We want to be transparent: we only recommend products or tools we genuinely think might be of interest to our audience, and any commission we receive comes at no additional cost to you.
We disclose the presence of affiliate links in accordance with Federal Trade Commission (FTC) guidelines, which require clear and conspicuous disclosure of affiliate relationships.
For example, a blog post might have a note saying “This post contains affiliate links. As an Amazon Associate I earn from qualifying purchases.” By including that, we ensure you are informed. Your trust is important, and our editorial content is not influenced by affiliate partnerships.
7.2 Third-Party Links: Our website may contain links to third-party websites that are not operated by us (for example, links to our social media pages, to Etsy, or to other blogs/resources). These links are provided for your convenience or reference.
We have no control over the content, policies, or practices of those external sites. Therefore, we cannot accept responsibility for any information or activities on those third-party sites.
When you click an external link and leave our site, you should read the terms and policies of the site you land on. If you have a bad experience with a site we linked, feel free to let us know – we value your feedback – but understand that we aren’t liable for any harm or damages arising from your visit to third-party sites.
7.3 Etsy and Other Marketplaces: In addition to our own website, Z.Harvest Gems has a shop on Etsy (an online marketplace). If you choose to purchase via Etsy or any platform outside our direct website, that transaction is governed by the platform’s terms (Etsy’s Terms of Service) and privacy policy.
Our shop policies on Etsy may mirror these Terms in many ways (regarding returns, etc.), but there could be differences due to Etsy’s system (for instance, Etsy may handle VAT for international buyers, etc.).

8. Disclaimer of Warranties
8.1 No Warranty for Website: Z.Harvest Gems provides this website and its contents on an “as is” and “as available” basis.
We make no express warranties or representations regarding the website’s operation or the information, content, or materials included. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the site will be uninterrupted, error-free, or free of viruses or other harmful components.
While we strive for accuracy, we do not warrant that product descriptions or other content are 100% accurate, complete, or current (although we do our best to correct any errors). You agree that your use of the site is at your sole risk.
8.2 Product Warranties: We stand by the quality of our handmade products. If an item has a craftsmanship defect on arrival (as discussed in the Returns section), we will fix or replace it.
However, we do not provide a formal long-term warranty on jewelry items. Jewelry can naturally tarnish or wear over time, especially silver or plated items, and how you care for it will affect longevity.
We provide care instructions (like keeping jewelry dry, avoiding chemical exposure) but we can’t guarantee that jewelry won’t ever break or lose finish in the long run. That said, if you encounter an issue soon after purchase that is clearly due to a production fault, reach out to us and we’ll make it right.
Permanent jewelry welds are meant to last, but again, if it breaks at the weld early on, we’ll re-weld it free.
No other warranties beyond this promise of initial quality are given. In particular, any risk associated with the permanent jewelry service (minor burns, etc.) is assumed by the customer per the waiver and this agreement – we make no warranty that the service is 100% risk-free, though we certainly operate with due care and skill.
8.3 Health and Allergy Disclaimer: We are not liable for any allergic reactions or skin sensitivities that customers may experience from wearing our jewelry. We disclose the materials used (for example, sterling silver is 92.5% silver with usually copper and sometimes trace other metals; gold-filled has a brass core with a thick layer of gold).
If you have skin allergies (like to nickel or copper), it is your responsibility to only purchase items that are compatible with your sensitivities.
We can answer questions about materials if you’re not sure.
Likewise, any information on our site about metaphysical properties of stones or any health-related suggestions (if provided) is not medical advice. For instance, if we mention that “amethyst is believed to have calming energy,” this is a cultural or folk belief and not a guarantee of any result.
Relying on such information is at your discretion; we do not warrant any such statements. Always seek professional advice for health or safety matters.
8.4 No Liability for Information Use: Any content on our site, including blog posts, guides, FAQs, or care instructions, is provided for general informational purposes.
We disclaim responsibility for how you use that information. For example, if we give jewelry cleaning tips, and you misuse a chemical and damage your jewelry (or injure yourself), we cannot be liable for that – use common sense and follow instructions carefully.

9. Limitation of Liability
To the fullest extent allowed by law, Z.Harvest Gems (and Tammi Zentic individually) will not be liable for any damages that arise out of or relate to your use of our site or purchase of our products/services, beyond the direct amount you paid us for the product or service in question.

We are not liable for indirect, incidental, special, punitive, or consequential damages (such as loss of data, loss of income, emotional distress, etc.), even if we have been advised of the possibility of such damages. For example, if our website is down and you interpret that as lost opportunity, or if a package is delayed and it ruins a gift surprise, we empathize but are not legally responsible for those knock-on effects.

If, for some reason, we are found liable for any claim, our maximum liability will be the amount you paid to us for the product or service at issue. You agree to indemnify and hold harmless Z.Harvest Gems, Tammi Zentic, and any associates or employees, from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of: your breach of these Terms, your violation of any law or rights of a third party, or your misuse of this site or our products.
In simpler terms, if you do something that causes us to be sued or incur costs because you violated these terms or acted unlawfully using our services, you’ll cover our costs.
Example: if you were to resell our digital content illegally and we got into legal trouble, you’d indemnify us. We don’t anticipate this happening, but it’s a standard clause to protect small business owners.
11. Governing Law and Dispute Resolution
11.1 Governing Law: These Terms and any separate agreements whereby we provide you services or sell products shall be governed by and construed in accordance with the laws of the State of Nebraska, USA, without regard to its conflict of law provisions.
This is our home jurisdiction. If you reside outside the US, you still agree that Nebraska law will apply (to the extent not overridden by consumer protection laws of your own state/country that cannot be waived).
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
11.2 Dispute Resolution: We truly value our customers, and we aim to resolve any issues amicably through our customer service.
If you have a dispute, please contact us first and we will try to resolve it in good faith. In the unlikely event we cannot resolve a dispute, you agree that any litigation shall be brought in the appropriate state or federal courts located in Nebraska, and you consent to the jurisdiction of those courts. You also agree to venue in Nebraska. (If you are a consumer residing in another state or country, you might have the right to sue in your local courts under certain consumer laws; this clause does not override any non-waivable rights you have, but we are stating our preference and agreement on jurisdiction.)
11.3 Alternative Dispute Resolution (Optional): We may be open to alternative dispute resolution methods like mediation or arbitration if both parties agree, but we have not made arbitration mandatory in these Terms. (Note: If Tammi wants to include a mandatory arbitration clause and class action waiver, that could be inserted here. For now, we’ll assume standard court resolution, since many customers might prefer the ability to use small claims court etc.)
11.4 Limitation on Claims: You agree that any claim or cause of action arising out of your use of the site or purchase of products must be filed within one (1) year after such claim or cause of action arose, or be forever barred. (Again, this may not apply where a longer period is mandated by law, but generally it prevents old claims from being brought after a long time.)
