Z.Harvest Gems (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy.

 

This Privacy Policy describes how we collect, use, and share personal information when you visit our website (https://www.zharvestgems.com) or interact with us, including making purchases online or in person, booking our permanent jewelry services, or engaging with our content. It also explains your rights regarding your personal information.

 

By using our services, you agree to the collection and use of information as outlined in this Policy. If you do not agree, please discontinue use of our site and services.

2. Information We Collect

We may collect various types of personal information from you in order to provide our products and services:

  • Information You Provide Directly: When you place an order or book a service, we collect information such as your name, billing and shipping address, email address, phone number, payment details (payment card information is processed securely by third-party processors, not stored on our servers), and any other information you voluntarily submit (e.g. if you contact us with an inquiry or provide additional details for a custom request).

  • Booking and Event Information: If you schedule a permanent jewelry appointment or sign up at an in-person event, we may collect your name, contact info, and any necessary details related to the booking (preferred chain style, etc.). If you sign a waiver or consent form at the time of service, we will retain that signed form which includes your name, signature, and acknowledgement of the terms.

  • Digital Products Information: If you purchase digital products (such as downloadable files) from us in the future, we will record the purchase details and your email (to deliver the product).

  • Automatically Collected Information: When you visit our website, our system and third-party services (like Wix, our website host, or analytics providers) may automatically collect data about your device and browsing. This can include your IP address, browser type, device identifiers, pages you view, and how you interact with the site (e.g. time spent, clicks). We also use cookies and similar technologies (see our Cookie Policy below or our dedicated Cookie Policy page) to remember your preferences and track site usage.

  • From Third-Party Platforms: If you find us via social media or interact with our social accounts (e.g. Instagram, Facebook) or buy through our Etsy shop, we may receive certain information from those platforms according to their terms (for example, Etsy provides us with necessary order details and your username when you make a purchase from our Etsy storefront). We treat and protect that information consistent with this Policy.

We do not knowingly collect sensitive personal information such as Social Security numbers, nor do we intentionally collect data from children under 13 (see Children’s Privacy below).

  • Order Processing and Service Delivery: To process and fulfill your orders for jewelry and other products, arrange shipping, send order and shipping confirmations, and provide the products or services you requested (including on-site permanent jewelry application at scheduled appointments).

Note that payments are handled by third-party processors (like Stripe, PayPal, Afterpay, etc.), so we use your information to initiate those transactions. For example, when you input your credit card at checkout, the information is transmitted to Stripe for processing; we do not store your full card number on our servers.

  • Communication: To communicate with you about your orders, appointments, or inquiries. This can include sending service-related emails or text messages (e.g. appointment reminders, order updates) and responding to any questions or customer support requests.

  • Marketing (with Consent): To send you updates, newsletters, or promotional offers via email if you have subscribed to our mailing list. You can opt out of marketing emails at any time by clicking “unsubscribe” in the email or contacting us directly. We will not spam you, and we will seek your consent where required (for example, by providing a checkbox at checkout or a sign-up form for newsletters).

  • Website Improvement and Analytics: To analyze site usage and improve our website’s design, content, and user experience. For instance, we may use Google Analytics or Wix’s analytics to see which pages are popular or to detect technical issues. This helps us make our site more user-friendly and to plan inventory or features according to user interest. We share personal information with third parties only in the ways described below, and only as necessary to run our business or as required by law:

  • Service Providers: We use reputable third-party companies to perform functions on our behalf. This includes:

  • Payment Processors: such as Stripe, PayPal, Apple Pay, Google Pay, Afterpay, Affirm, Klarna – they receive your payment details when you check out, to process the transaction. These processors are responsible for your payment data and have their own privacy policies. We share only the necessary information (purchase amount, your billing/shipping info, etc.) for them to authorize and complete the payment.

  • Website Host: Our site is built on Wix.com, which stores site data and may incidentally process your info (e.g. form submissions) on its servers. Wix and similar providers may collect technical data (IP, device info) as part of providing their hosting service. We have ensured our use of Wix is under terms that safeguard data, but note that by using our site your information might be processed by Wix’s infrastructure.

  • Shipping Partners: We share your name and shipping address (and phone/email as needed for delivery updates) with postal or courier services (e.g. USPS, UPS, FedEx or others) to ship your orders.

  • Analytics/Advertising Partners: If we use third-party analytics (like Google Analytics) or social media pixels (like a Facebook Pixel for ads), these tools set their own cookies to collect usage data. Those third parties process data for analytics/advertising on our behalf.

  • Email Service: If we send newsletters, we may use an email service platform (for example, MailChimp, ConvertKit, etc.), which stores your email and name to manage the mailing list.
    All such service providers are only given the information needed to perform their functions, and they are contractually obligated to keep your data secure and use it only for those purposes.

  • Etsy Platform: If you make a purchase from our Etsy shop (Z.Harvest Gems on Etsy), your transaction is conducted through Etsy. We receive necessary details (like your name, shipping address, order details) from Etsy to fulfill your order, but we do not control data collection on Etsy’s platform. Etsy has its own privacy policy and terms. This Privacy Policy applies only to data we collect directly through our own website or offline; data processed via Etsy is covered by Etsy’s privacy rules. However, we still treat any information we obtain from Etsy with confidentiality and use it only to complete your Etsy order or provide customer service.

  • Legal Requirements and Business Transfers: We may disclose information if required by law or legal process, for example in response to a subpoena, court order, or government demand. We may also disclose data to enforce our rights or agreements (such as sharing information with law enforcement to handle fraud or security issues). In the unlikely event that our business is involved in a merger, acquisition, or sale of assets, user information might be transferred to the successor entity. If that happens, we will ensure your information remains protected and inform you of any changes.

  • Your Public Posts: If our website allows product reviews or blog comments and you choose to post content, any personal information you include in those public areas (like a review with your name or a photo) can be seen by others. We advise caution in sharing personal details in any public forums. We moderate user-generated content to remove anything sensitive, but ultimately posting is at your discretion.

We will honor such requests to the extent possible – note we may retain certain transaction records as required for legal or internal business purposes (e.g. we might need to keep a record of sales for tax accounting, but we can delete unnecessary data like a newsletter subscription on request).

  • Opt-Out of Marketing: If you’ve subscribed to our newsletter or marketing emails, you can unsubscribe at any time. Every marketing email will have an “unsubscribe” link. You can also email us at any time to be removed from marketing lists. (Transactional emails about orders or responses to inquiries are not optional, as they are necessary for customer service.)

  • California Residents: If you are a resident of California, you have specific rights under the California Consumer Privacy Act (CCPA) and California Online Privacy Protection Act (CalOPPA). These include the right to know what personal information we collect, the right to request deletion of your personal data, and the right to opt-out of the “sale” of personal information (though we do not sell data). You also have the right not to receive discriminatory treatment for exercising these rights. To make any CCPA-related request, please contact us using the info in Section 8. We will verify your identity and respond as required by law.

  • European Union (GDPR): While we primarily operate in the US, if you are an EU/EEA/UK resident, you have rights under the GDPR including access, rectification, erasure, restriction of processing, and data portability. You also have the right to object to certain processing (like direct marketing), and the right to lodge a complaint with a supervisory authority in your country. We will extend GDPR rights to EU customers even though we may not be established in the EU, as a courtesy and best practice. If you wish to exercise GDPR rights, contact us and we will assist you.

  • Do Not Track Signals: Some browsers offer a “Do Not Track” (DNT) feature. Our site does not currently respond to DNT signals (if applicable). Because there is not yet a common standard for DNT, we treat all visitors’ data as described in this policy. You can opt out of certain tracking (like Google Analytics) as mentioned in the Cookie Policy.

We will not discriminate against you for exercising any privacy rights.

 

For example, if you ask to delete your data, we will still treat you fairly in any future dealings (though note we cannot provide certain services without some data – e.g. if you want to place an order but don’t allow us to use your address, we can’t ship to you).

7. Data Security and Retention

We take reasonable measures to protect your personal information from unauthorized access, alteration, or loss. This includes using secure technologies (our site is HTTPS encrypted), choosing reputable third-party processors (who use security protocols like PCI-DSS compliance for payments), and limiting employee access to customer data on a need-to-know basis.

 

However, no method of transmission over the Internet or electronic storage is 100% secure, so while we strive to use commercially acceptable means to protect your info, we cannot guarantee absolute security. Please safeguard any account password and use caution when sending sensitive information via email.

We retain personal information only as long as necessary for the purposes outlined in this Policy or as required by law. For example, we may keep order records for several years to comply with tax and accounting laws. If you request deletion of your data, we will remove what we are not obligated to retain.

 

Even after deletion from active databases, residual copies might remain in backups (these will be purged in the normal backup retention cycle).

 

We store personal data in the United States (and potentially on cloud servers that could be in other countries depending on our service providers, though we aim to work with providers that store US customer data in the US when possible).

 

If we ever experience a data breach that poses a significant risk to your rights (for instance, a hacker gains access to our customer database), we will notify affected individuals and/or authorities as required by law.

8. Children’s Privacy

Our services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13.

 

In accordance with the U.S. Children’s Online Privacy Protection Act (COPPA), if we learn that we have inadvertently collected personal data from a child under 13 without proper parental consent, we will delete that information.

 

If you are a parent or guardian and believe we might have any information from or about a child under 13, please contact us immediately so we can take appropriate action.

For minors aged 13 to 17: Our website may be used to browse products, but purchases should be made by adults. If a minor (under 18) wants to use our permanent jewelry service, a parent or legal guardian must approve and accompany them, as described in our Terms and Conditions.

 

We do not intentionally solicit personal data from minors without guardian consent. Any information provided about a minor for a service (e.g. a parent booking an appointment for their 16-year-old with parental consent) is assumed to be provided with authority of the parent/guardian.

9. Third-Party Websites and Services

Our website may contain links to third-party websites or integrations (for example, a link to our Etsy store, or social media buttons that lead to platforms like Facebook/Instagram). This Privacy Policy does not apply to those external sites.

 

We encourage you to read the privacy policies of any third-party sites you visit. We do not control the content or data practices of these external services, and your interactions there are governed by their policies.

 

For example, if you click an affiliate link on our site that takes you to another retailer’s site, any data collected on that other site is under their control.

 

We are not responsible for the privacy practices of other sites, but we welcome feedback if you have concerns about any external links we provide.

We may update or revise this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons.

 

If we make significant changes, we will notify users by posting a prominent notice on our website or by emailing those who have provided an email address (for example, for account holders or newsletter subscribers).
